Legislative Achievements
The
Iowa Tire Dealers Association has had a presence in the state legislature since
January of 1983. Executive Director, Joe Kelly, is a professional lobbyist
representing several different groups including the Iowa Tire Dealers
Association.
1. Defeated a bill which
would have placed a $3.00 tax on passenger tires at retail.
2. Passed language which
requires landfills to accept properly processed tires. It is the only waste
product that landfills are required to accept.
3. Passed language
exempting tire dealers from having to register as tire haulers when moving their
own scrap tires to a permitted waste facility. Dealers save money by not having
to purchase a bond and by not having to meet other costly regulations.
4. Defeated a bill which
would have prevented oil filters, properly drained, from going to landfills.
5. Defeated a bill which
would have prevented dealers from charging customers for tire disposal.
6. Developed a legal form
for tire dealers to use with companies who haul their scrap tires. This form
helps limit dealer liability.
7. Worked to get the
definition of a properly processed scrap tire from 12 inch sections to 18 inch
sections, allowing dealers to buy less expensive equipment to process a tire.
8. Worked with the
Department of Revenue in reaching their position that the disposal of waste
tires is a service which is not subject to the sales tax.
9. Passed a law which
prevents waste oil from being designated as hazardous waste if the oil is burned
under EPA guidelines for purposes of volume reduction, heat production, or
energy co-generation.
10. Helped pass a law
which raised small claims court limits from $2000 to $4000.
11. Helped pass a new bad
check law raising the fees which can be collected by retailers.
12. Passed legislation
which gives legal immunity from abatement costs to tire dealers and other
generators of scrap tires if it is shown that the generators of the scrap tires
dealt with legal entities to dispose of the tires.
It
makes sense to belong to an association.......
